"These Terms and Conditions, provided by Merkle Tech Labs, constitute a binding agreement for the sale and use of Keepix products and services."
1. Liability and User Responsibility
Merkle Tech Labs expressly excludes liability for losses incurred due to user error, unauthorized access, or mismanagement of wallets and funds. Users are expected to exercise diligent care in securing their accounts and adhering to recommended security protocols.
2. Hardware Device Usage
Keepix hardware must be used in accordance with the provided guidelines. Merkle Tech Labs is not responsible for damages resulting from improper use, unauthorized modifications, or neglect. Users are advised to follow all operational instructions to ensure device integrity.
3. Refund and Return Policy
Refund and return requests for Keepix hardware are subject to strict review. Once an order is processed, cancellations or changes are not typically permitted, except in compliance with UAE consumer protection laws.
4. Disclaimer of Warranties
Keepix products are provided 'as is', without any warranty of performance. Merkle Tech Labs disclaims all implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
5. General Legal Disclaimer
Merkle Tech Labs limits its liability to the maximum extent permitted under UAE law. This includes exclusion from indirect, incidental, or consequential damages that may arise from the use of Keepix products and services.
6. User Content Rights
Users retain full ownership of their content uploaded to Keepix. This content will be utilized strictly for the purpose of providing requested services and will not be shared or commercialized without explicit user consent.
7. Data Access and Deletion
Keepix may require access to user data for operational purposes. Users have the right, under UAE data protection laws, to request the deletion of their personal data and images from our systems.
8. Content Restrictions
Content uploaded to Keepix must adhere to UAE laws and ethical standards. Prohibited content includes, but is not limited to, material that is defamatory, obscene, or infringes upon intellectual property rights.
9. Service Use Limitations
Keepix services are to be used in a lawful manner. Any misuse or actions contrary to UAE laws and regulations may result in access restrictions or legal consequences.
10 - Indemnification
You agree to indemnify, defend, and hold harmless Merkle Tech Labs and its employees, directors from any liabilities, damages, claims, costs, or expenses (including legal fees) arising directly or indirectly from: (a) your breach of these Terms of Use; (b) any claim, loss, or damage experienced from your use or attempted use of our platforms or services; (c) any violation of laws or regulations by you; (d) your infringement of any third-party rights; and (e) any other actions for which you are responsible under current legislation.
